PLAN FOR CONTINGENCIES! BUILD DELAYS INTO YOUR PRODUCTION SCHEDULE.

ALL ORDERS ARE SUBJECT TO THE MINIMUM TURNAROUND TIME OF 45 WORKING DAYS FROM THE TIME THE MANUFACTURING PLANT ACCEPTS OUR ORDER ON YOUR BEHALF (unless changed by this office). ALL ORDERS ARE SUBJECT TO THE MINIMUM QUANTITY FOR THE TYPE OF MATERIAL YOU ARE ORDERING. (If your order falls below the minimum and the job is accepted a below-minimum-fee will be charged. Your order will be added to the production list, and when the minimum is reached for your particular confirguraion by combining orders,then your job will be run).

1. In order to serve you better we cannot respond to any E-mail that does not include your name, business name, address, phone and extension, fax number, business web site address, and email address. We do not accept confidential email.

2. We sell only to businesses.

3.All products and services supplied by Ledge Hill Advertising:
+All orders require a signed Purchase Order from customer.
+All prices estimated do not include artwork, proofs, shipping, handling, alterations, changes, and applicable tax in Maine.
+ PARTIAL SAMPLES and FULL SHEET SAMPLES must to be purchased. We will gladly ship to you using your shipper number and a material charge. Limited to suppliers stock.
+ ORDERING WITHIN THE CONTINENTAL USA: A Purchase Order number showing complete details and pricing is required for each order placed. All orders, conditions, and pricing subject to review for accuracy and acceptance by ProductionRubber.com and our supplier(s).
+ ORDERING OUTSIDE THE CONTINENTAL US: All pricing and payments made in USD only and requires full payment via PayPal® Invoice, certified banck check or wire funds to our account along with your purchase orde. It is your responsibility to arrange for shipping from the USA to your country.
+ PAYMENT: Pre-payment with Business Check, Cashiers Check, PayPal Inoice using your credit card, or Money Order along with your Purchase Order. After check clears or payment is verified, order will be placed, per ours and our suppliers terms. Make all checks etc. payable to the appropriate unit. For Ledge Hill Advertising make checks payable to Ledge Hill Advertising, Overdue invoices see #34 below.
+ DELIVERY: All deliveries are standard acceptable delivery plus or minus 10%. For exact amount an additional charge may be incurred. Call for details.
+ RUSH ORDERS AND PROOFS: There may be a charge for rush orders. By applying a Rush status to your project absolves and holds harmless Roger Pignataro dba Ledge Hill Advertising,our suppliers and maufacturers from any errors or ommissions or any other problem that arises from cancelling the proof stage. Customer absorbs any and all legal, reproduction, changes, dies, materials and shipping costs that arises from the cancellation.
+ Purchaser agrees that any products purchased from us will be used for lawful purposes only
+ Billing and shipping will be direct from our supplier either pre-paid or using your shipper number.
+ Ledge Hill does not collect sales tax from states other than Maine. We do not collect taxes from countries.
+ All sales final. No refunds or exchanges. 25% restocking fee. $40.00 returned check fee.
+ Any information discussed or given either in writing, by telephone, or electronically submitted to you or your representative is purely and solely opinion and is not intended to be followed up on or attempted. It is your responsibility to test all theories, processes, material and legalities and accept their eventual outcome. For products, adhesives, and any and all materials used in a project there are no warranties, warranties of performance, and no guarantees or any kind. You take full responsibility and you hold Ledge Hill Advertising, ProductionRubber.com a unit of Ledge Hill Advertising, our suppliers and manufacturers harmless from injury, loss of work, time, income, or machinery damage.

+ Purchaser agrees that by the sending of their purchase order that any product(s) purchased through ProductionRubber.com a unit of Roger Pignataro dba Ledge Hill Advertising, our suppliers or manufacturers will be used for lawful purposes only.

+ All estimates or orders are subject to these complete terms and conditons. Our terms override all client and supplier terms.

+ Prices and delivery dates subject to change without notice, and any problems that can alter a delivery date are part of this qualifier. It is your responsibility to plan for these delays.

+ TEST ALL MATERIALS BEFORE USE.

+ DELAYS: Roger Pignataro dba Ledge Hill Advertising or ProductionRubber.com a unit of Roger Pignataro dba Ledge Hill Advertising shall not be liable for any delays or defaults or any contract or orders caused by riots, strikes, fires, floods, late transportation, accidents or any other contingency beyond our control.

+ Due to the manufacturing process there might be areas where angles are not exact nor tolerances fully met. This is the nature of the process and an exact cut cannot be guaranteed. Also the manufacturing process can alter the “color” of the substrate.

+Full payment required to start a project.

+ Ledge Hill Advertising and ProductionRubber.com a unit of Ledge Hill Advertising’s failure to object to any of the items or terms in a customer purchase order or any other communication(s) shall not be taken as a waiver of the Ledge Hill Advertising or ProductionRubber.com terms and conditions herein or overall not acceptance of such provisions. No representation or guarantees other than those contained within our organization or herein has will not be binding upon Roger Pignataro dba Ledge Hill Advertising or ProductionRubber.com a unit of Roger Pignataro dba Ledge Hill Advertising unless made in writing and signed by Roger Pignataro, proprietor.

+ CANCELLATION: Orders are not subject to cancellation without the consent of Seller, and then only on condition that Seller shall be reimbursed for all loss, damage or expenses, plus all shipping cost incurred.

+ Payment terms as indicated are subject to the approval of our credit department.

If you send us the form by any means and it is not filled out in its entirety including your complete business contact information your request will be deleted with no further contact.

9. We do not accept credit card, or cash sales at this time, except sales made directly through our suppliers who accept such payment if we direct you to them. Such sales are governed by the supplier you purchase from, and Ledge Hill Advertising is held harmless from any dispute that may arise from our recommendation to you of any particular supplier whether or not a commission is given to Ledge Hill Advertising and ProductionRubber.com for the sale.

11. At Ledge Hill Advertising and ProductionRubber.com we work with purchase orders and pre-payment only. Terms to be determined at the beginning of each project.

Any dispute that may arise in conjunction from the sale of product or service, either from this web site, or Ledge Hill Advertising and ProductionRubber.com in general will be governed by the complete laws of the State of Maine. Any dispute will be heard and are subject solely to jurisdiction of Federal and State courts located in the state of Maine.
13. It is the responsibility of the customer to certify that all copy and artwork supplied by you, the customer, meets any and all copyright laws, and laws governing use of materials in the United States of America and worldwide. You must send a release for the use of such art or photograph(s).
14. Any data, either electronic or CD, Zip, floppy, and stored in our computer(s) or other storage device is not guaranteed or insured by Ledge Hill Advertising and ProductionRubber.com for you. You store your information at our site (or off-site in our computer) IS STORED AT YOUR OWN RISK. Any lost information that needs to be redone or updated due to loss, theft or fire, or any other accident or mishap or Act of God will be done so at the expense of the customer. Send us ONLY A COPY of artwork and not the original.
15. Downloading, storing and /or changing this information, or any information on this web site is strictly prohibited.
16. Indemnification. Purchaser agrees to defend, indemnify and hold Ledge Hill Advertising and ProductionRubber.com. harmless from any claims, losses and damages, including attorney fees, relating to any use or misuse by Purchaser of the purchased products.
17. Payment in full, (including shipping and handling), by cashiers check or money order with a tracking number. Product sold per our suppliers, manufacturers and Ledge Hill Advertising and ProductionRubber.com terms and conditions as stated here. No credit cards accepted, except direct purchase by you from our sponge rubber supplier if we direct you to them. Production times varies. Generally on non-special orders you should expect a lead time of three to six weeks. On special orders that time can be from four to twelve weeks upon our suppliers acceptance of our purchase order and generation of their own, depending on availability and any other items that are beyond our control.
18. All prices when estimated do not include artwork, proofs, shipping, handling, packaging and any applicable tax(s).
19. To order full size samples, sold at prevailing cost per unit, call with your shipper number and a purchase order.
20. A Purchase Order number is required for each order placed if ordering through Ledge Hill Advertising and ProductionRubber.com.

It is you, the customer, that must authenticate the materials suitability in meeting any need and/or specification you require or demand, and to test the product by use of an independent testing laboratory to determine reliability for the use in your particular application and environment.  CUSTOMER ASSUMES ALL LIABILITY(IES) for using the product by any means in any machinery or under any condition and used by anyone. WARNING, do not cut the material. Cutting the material should be accomplished by trained personnel with the proper machinery and safeguards in place to do the slicing. Customer assumes all liability for performance, handling and processing the material. Prices subject to change without notice. Upon confirmation of payment your order will be placed. For orders over fifteen-thousand one dollars a seventy-five percent deposit is required. 25. We do not accept confidential or classified E-mail. If you send it and we receive it, its security and confidentiality is not guaranteed and we are held harmless against any action by any party involved, and is subject to these terms and conditions.

27. Any project that is passed along to one of our suppliers via our giving you their contact information, and you purchase from them, their terms and conditions apply as well. Any problems or questions that arise between you and the supplier we have recommend you contact become yours and the recommended suppliers and you to resolve and Ledge Hill Advertising and ProductionRubber.com is held harmless.
28. Ledge Hill does not collect state sales taxes from states other than Maine. It is your responsibility to report sales tax to your governing body.
29. Ledge Hill Advertising and ProductionRubber.com and/or our suppliers reserve the right to review purchase orders and make changes to any incorrect information, a copy of which will be sent to your as "purchaser" for correction.
30. For Ledge Hill Advertising projects a start up fee for all projects with a gross of one thousand dollars or more will be charged five hundred and fifty (550.) as part of our service and job administration, and covers all expenses in the performance of the job, and may include the absorption of small increases. Standard industry mark up of up to forty percent is common on some out sourced projects. You will be notified if this is different.
31. ALL SALES FINAL. NO REFUNDS OR EXCHANGES. !!INSPECT ALL PRODUCTS UPON ARRIVAL AND TEST ALL PRODUCTS BEFORE USE!! Pricing, terms, conditions and security subject to change without notice. The maximum liability will be the refund of your deposit less any real expense such as shipping and handling charges items ordered or samples. A restocking fee of 25% plus shipping charges will be charged where and when applicable. Standard acceptable delivery of plus or minus 10% constitutes an acceptable delivery. All products must be inspected upon arrival and, if any defects are detected the material shall not be used and you notify us immediately. If you use the material that means you have unequivocally accepted the same . No claim can of any kind shall be made after the acceptance of the material by you and no greater in amount that the purchase price of the material in respect of which such claim is made. In other words, the most that you can expect is your deposit or money back that you have sent to us. Your acceptance of the product is full acceptance of all terms and conditions..
32. All pricing, if needed, will be adjusted to meet current cost criteria. Ledge Hill Advertising, ProductionRubber.com, or their suppliers retain the right to cancel any and all orders without penalty.
33. Delivery: Unless you give us an exact time frame to complete a project, we do not guarantee exactly when a project will be completed if it is custom in nature as we rely on many layers of suppliers to make your project. We will be your advocate to expedite the process as much as possible.
34. Overdue invoices will be billed interest at 2% (two percent) per month (24% annually) on the unpaid balance on accounts over 30 days. Overdue invoices will be turned over to our attorney or a collection agency.
35. Our advice or opinions, whether solicited or unsolicited remain as opinions for your review and testing.
36. Purchaser agrees that any products purchased from this web site will be used for lawful purposes only.
37. Entire Agreement. These terms and conditions, together with the invoice itemizing the purchased products represent the complete agreement and understanding of the parties with respect to the goods purchased hereunder, and supersede all other agreements, representations or understandings. These terms and conditions may not be waived or modified except by a written agreement signed by both parties.
38. ***! WARNING: Some rubber or foam may contain latex and/or other allergic materials and, in those individuals, may cause harm. Use proper handling techniques. !!TEST ALL PRODUCTS BEFORE USE!!
39: The accuracy of all descriptive materials for products not manufactured by DBA Ledge Hill Advertising or ProductionRubber.com a unit of DBA Ledge Hill Advertising is the responsibility of our supplier and/or manufacturer.
40: CANCELLATIONS. Any order placed are not subject to cancellation without the consent of the Seller and, if cancellation is accepted by the Seller it is only on the condition that the Seller shall be reimbursed for any and all losses, damages or any other expense plus shipping cost(s) incurred for the project, job or order cancelled.
41: DELAYS: ProductionRubber.com, a unit of Roger Pignataro DBA Ledge Hill Advertising shall not be held liable for any delay, failure to complete an order, defaulting on any order, or any contract due to items beyond out control as acts of God, strikes, floods, fires, transportation issues such as no transportation available, breakdown in transit, or any accident or other contingency beyond ProductionRubber.com, a unit of Roger Pignataro DBA Ledge Hill Advertising.
